What Probably is
Probably is an AI video studio at studio.probably.co. An AI crew writes, casts, films, edits and reviews video ads from your brief. Probably is run by a sole proprietor. In these terms, "we" and "us" means Probably, and "you" means the person using it and any business they use it for.
Your account
- You sign in with a Google account. Keep it secure: anything done while you're signed in counts as done by you.
- You must be old enough to agree to these terms where you live, and at least 18.
- Probably is in early access, so we may limit who can sign up.
- If you use Probably for a business, you confirm you're allowed to agree to these terms for it.
Organizations and members
Your work lives in an organization. Its owner decides who joins and what each member may do, and is responsible for how its members use Probably. Every member can see every Space in the organization. An owner can delete the organization; it can be restored for 30 days, and after that its videos and files are deleted.
Credits, plans and the free draft
- Credits pay for the work that goes into your ads. The studio shows an estimate before paid work starts, and you can set spending limits.
- Plans add credits each month. Those credits expire at the end of that month, on monthly and yearly plans alike.
- Credits you buy as a top-up never expire. Credits from a promotion or coupon expire 30 days after you get them.
- Videos spend the credits that expire soonest first. Credits belong to the organization and have no cash value.
- A new account gets one free 480p draft of up to 30 seconds, to start within 30 days of signing up. Free drafts are limited each day, and we may hold one for review to stop abuse.
Payments and refunds
Payments go through Whop, which handles checkout, your payment details and receipts. Subscriptions renew until you cancel, and you keep your plan until the end of the period you paid for. Yearly plans are paid upfront, with credits added each month.
All sales are final, and payments aren't refunded unless we make an exception or the law requires it. To ask, email hi@probably.co. If a payment is refunded or disputed, we remove the credits it bought, in proportion to the amount refunded.
What you make, and who owns it
- You keep the rights you have in what you upload: briefs, product photos, logos, voices and footage.
- As between you and us, the scripts, images and videos Probably makes for you are yours to use, including in paid ads.
- You let us store, process and copy your uploads and videos, and send them to the AI providers that do the work, only to run Probably for you.
- AI can make mistakes, and similar briefs can lead to similar results for other people. Check every ad before you publish it, including its claims, captions and spelling.
What you may not do
Follow our AI content policy. Don't break the law, and don't try to break, overload or get around Probably's limits, including its free-draft limits. If you use our API or MCP server, keep your keys private.
Share links
A share link lets the people you choose watch and download a video. You choose when it expires, and you can turn it off at any time. A viewer can report a video, and we may turn off a link that breaks these terms.
Affiliates
Our affiliate program runs on Whop. If you join it, these terms apply to you as an affiliate as well as Whop's own terms:
- You earn 8% of each payment a customer you referred makes, from their first payment, for as long as they stay a customer. A customer counts as yours when your link is the last one they followed to Probably, no more than 90 days before they buy.
- Whop tracks referrals and pays commissions, after its waiting period and to your Whop account. We don't pay commissions ourselves.
- A refunded or disputed payment earns no commission, and a commission already paid on it may be taken back.
- You may not refer yourself or your own organizations, bid on our brand name in search ads, send spam, or say that you speak for Probably. Describe Probably truthfully, and say that you earn a commission where the law or the platform asks you to.
- We may change the program or its rates, or end your participation, with notice here. Commissions you already earned stay yours.
If something goes wrong
- We provide Probably as it is, without promises that it will always be available or free of errors.
- AI providers we rely on can refuse a request, change or stop. When that happens we may change how Probably makes a video.
- As far as the law allows, we aren't liable for indirect losses such as lost profits, and our total liability is limited to what you paid us in the 12 months before the claim.
Ending your use
You can stop using Probably at any time, and you can cancel a plan in Billing. To close your account, email hi@probably.co. We may suspend or close an account that breaks these terms or puts others at risk, and we'll tell you why unless the law stops us.
Changes and questions
We'll change these terms as Probably changes. When we do, we'll post them here with a new date. Questions? Email hi@probably.co.
